China: Thanks for the intellectual property theft

If you’ve followed or read my blog for any length of time, you know that I have this gut-level aversion to spammers, scammers, sleazy advertisers, and just about anyone who takes money from others by way of lies or deception. I execrate these people with the fury of a thousand O-type blue-hot suns.

Say hello to the Rinne Corporation, two guys who put their heads together and invented a better mousetrap.

Sit this bad boy on top of a 5-gallon bucket, bait the top, and watch the vermin enjoy their last slip-n-slide. For what it’s worth, I just ordered one from them this morning.

Naturally, Chinese businessmen who have all the ethics and morals of a starving honey badger saw these things, and as countless thousands of them do, ripped off the idea, started manufacturing knockoff copies, and selling them all over the Internet (including Amazon).

Amazon listings for the Flip-and-Slide bucket trap. Only the first one, from Rinne, is genuine. The others are cheap knockoffs from China for which Rinne gets no benefit.

Amazon states for the record that they are “trying” to shut down illegitimate storefronts, but based on results they are not putting a whole lot of real effort into it, and every day these scumbags exist on their website, they’re making money – so they don’t really have a lot of incentive to do much about it.

And of course the Chinese Communist Party encourages this theft of Intellectual property. National industrial policy goals in China encourage IP theft, and an extraordinary number of Chinese in business and government entities are engaged in this practice. There are also weaknesses and biases in the legal and patent systems that lessen the protection of foreign IP.

As the new Chinese leadership settles in, IPR issues loom. The fundamental question is whether the new leaders will confront the major societal and policy forces that continue to work against IPR. The patent and trade-secret legal environments, for example, require reform. The patent system encourages Chinese entities to copy and file foreign patents as if these patents were their own, and seems to establish the right of Chinese entities to sue the foreign, original inventor that seeks to sell the technology in China.

In 2021, based on what is being seen on the Internet and elsewhere, the problem is not only not being addressed, but is proliferating at an exponential rate. Facebook¹ doesn’t care; Google doesn’t care. They’ll happily take money from deceptive advertisers without a second thought.

The first company (, great name right?) has its mailing address in Reykjavik, Iceland, with tech support listed in Burundi, according to ICANN. The second, “Find Good Gear” makes no attempt at misdirection but is registered in China. The third one,, appears to be an identical copy of the first one with only the name differing. All three websites have the following somewhere:

Even with access to a Roget’s Thesaurus (both in hard copy and online), I do not have words enough to express how badly this kind of repugnant jiggery-pokery enrages me. Sales by theft of property, sales by outright lies and deception are the hallmark of China’s business model, and there’s not a thing honest businesspeople can do about it. Our government works so ponderously that by the time anything is done (and what is done will be a pathetic, watered-down version of what should be done), the criminal enterprises will have made a fortune, disappeared into the mist, and reappeared under a new name selling a new pirated product.

The only thing consumers can do is take the time to make sure they are buying from American companies, and preferably the originators of products they see. It takes time and effort, but if we’re ever going to turn the tide against conglomerates who outsource everything overseas, it will be worth it.

Every single one begins with a variation of “We are sad to announce that we are closing our collection.” This is the purest horse 💩, and people fall for it in droves. This is similar to the signs I see periodically – there used to be an outfit in San Francisco’s Chinatown that had one of these on their storefront for years:

They’re closing their collection all right… and they’ll be back next week under a new name, peddling the same cheaply-made and overpriced stuff that they are now.

And that’s not to mention the ever-present teeshirt vendors who photoshop celebrities into their ads for products with stolen, unauthorized artwork. As the linked website says,

When those products are infringing on copyrights, or are misappropriating celebrity images, it’s incumbent on Facebook to crack down on them.

But they’re not, because it hurts their bottom line when they do.

Domain Registraton Scam – Bad Actors from China

Be careful out there. I just got this email the other day, and while it looked dodgy from the outset, I thought I’d follow it down the rabbit hole to see where it went.

Dear sir or madam,

We are a registrar for domain names authorized by Chinese government. Today, we received an application from Daoc International ltd applying to register [domain] as their brand name and some top-level domain names(.CN .HK etc). After our initail checking, We found the main body of domain names is same as yours.

We are handling the application and we need to confirm whether or not you authorize them to register them? Let me know your positon ASAP so as to solve it promptly. Looking forward to your reply.

OK. So I simply responded and said, “These domains are not authorized, thank you.”

Followed the same day by this:

Notice: hi, i am Elvin Lee. We had discussed the case about disputing your company’s brand name. You have never registered the brand name, the dispute period will come soon. If your company does not register the brand name, we will start aforesaid company registration within 2 workdays. That company will become the legal owner of the brand name in the world. We had notified you, so we are not responsible for any dispute question about your intellectual property right and trademark after they succeed in registration. If you have any questions, pls contact us within 2 workdays.

Basically telling me I’ll lose worldwide rights to my domain name if I don’t quickly take action, or alternatively, I should abandon my own domain so that they can legally register it with other companies.

Lastly, today:

Thanks for your confirmation. As soon as receiving the application of that company, we checked and found [domain] is your company’s using name. We are concerned that your name might be affected negatively by their applications, this is why we informed you. Following brand name and domain names are applied by that company:

Uh, no. While I have no doubt that there are many good and honest Chinese businesses, this is not one of them – in fact, falls under the rubric of “morals of a honey badger.”
Above and beyond the standard advice, “Never deal with spammers,” I’d add that you be extraordinarily careful when unsolicited business proposals come from China – in other words, be doubly vigilant.

The amount of business that is being done in the world based on dishonesty and deception makes my head hurt.

There’s bad translation, and then there’s this.


Found this abomination at the “Selling It” section of the May 2014 Consumer Reports. is full of such things, but this example is so egregious I felt as though it deserved its own shout-out.

The accompanying text said,

“Bang Indeed. The buyer who inserted this battery in his new “pay as you go” phone needn’t have worried about the warnings. “Sure enough,” he writes, “the phone did not work.”

I’ve talked about products made in China before, but it’s also worth remembering that the appetite for cheap Chinese goods is not driven by the Chinese exporters and manufacturers, but rather by American importers who buy their junk, exerting such downward price pressure on their suppliers that the quality goes from the toilet into the septic tank. It’s difficult to walk through Wal-Mart or Dollar Tree, to name two examples, without finding “Made in China” stamped on the goods. While getting American families up to living wage standards would help, it would take a miracle to break people of the habit of buying cheap trash just to save a dime. Frankly, I don’t have an answer, but I know that the current situation is doing nobody any good, except for those who manufacture and sell this type of garbage, balancing their bankbook on the backs of low-wage workers and low-wage consumers.

I have received two communications from HSBC in India. They are requesting an inital deposit of over $900.00 to set up an account there. I responded thusly:

Well i contacted the bank and only to know that you gave a police phone no and you are not ready for this transaction so i ask them to stop the transfer as i will look for someone to help me out.
(Evidently he actually tried the phone number I gave him, and was connected with the San Francisco Police Department. Oh noes!)

The letter came in a box of Halloween decorations purchased at Kmart, but for a year Julie Keith never knew. It gathered dust in her storage, a haunting plea for help hidden among artificial skeletons, tombstones and spider webs.

Keith, a 42-year-old vehicle donation manager at a southeast Portland Goodwill, at one point considered donating the unopened $29.99 Kmart graveyard kit. It was one of those accumulated items you never need and easily forget. But on a Sunday afternoon in October, Keith pulled the orange and black box from storage. She intended to decorate her home in Damascus for her daughter’s fifth birthday, just days before Halloween.

She ripped open the box and threw aside the cellophane.

That’s when Keith found it. Scribbled onto paper and folded into eighths, the letter was tucked between two Styrofoam headstones.


“If you occasionally buy this product, please kindly resend this letter to the World Human Right Organization. Thousands people here who are under the persicution of the Chinese Communist Party Government will thank and remember you forever.”

“People who work here have to work 15 hours a day without Saturday, Sunday break and any holidays. Otherwise, they will suffer torturement, beat and rude remark. Nearly no payment (10 yuan/1 month, or $1.61).”

“People who work here, suffer punishment 1-3 years averagely, but without Court Sentence (unlaw punishment). Many of them are Falun Gong practitioners, who are totally innocent people only because they have different believe to CCPG. They often suffer more punishment than others.”

The letter was not signed.


The graveyard kit, the letter read, was made in unit 8, department 2 of the Masanjia Labor Camp in Shenyang, China. Chinese characters broke up choppy English sentences.

Keith started doing homework and digging around, and the letter was widely published on the internet. Responses ranged from outraged to skeptical, including those who pointed out that her publication of this material put the writer at risk if he/she were real.

On June 11th, 2013, The New York Times published a follow-up article indicating that the writer had been found, and was no longer in the labor camp. It’s an interesting read and lends credence to the original story, although there has been no other independent confirmation from inside China.

It appears that many companies who import Chinese products have no policies that bar the use of forced labor.

Just something else to think about the next time you go shopping at a big box store and the label says “Made in China.”

The Brick Story

No, not the one about the lady on the airplane and the guy with a cigar. That’s from about 1960. This one is about 600 years older than that.


Jiayuguan or Jiayu Pass is the first pass at the west end of the Great Wall of China, near the city of Jiayuguan in Gansu province. It has also been called “Jiayuguan Pass”; however, this form is tautological since “guan” means “pass” in Chinese. Along with Juyongguan and Shanhaiguan, it is one of the main passes of the Great Wall. Construction began sometime around 1372.

Among the passes on the Great Wall, Jiayuguan is the most intact surviving ancient military building. The pass is also known by the name the “First and Greatest Pass Under Heaven” (天下第一雄关), which is not to be confused with the “First Pass under Heaven” (天下第一关), a name for Shanhaiguan at the east end of the Great Wall near Qinhuangdao, Hebei.

There is a famous legend regarding the building of this amazing monument. I have heard two versions, so I present them both here:

  1. A fabulous legend recounts the meticulous planning involved in the construction of the pass. According to legend, when Jiayuguan was being planned, the official in charge asked the designer to estimate the exact number of bricks required and the designer gave him a number (99999). The official questioned his judgment, asking him if that would be enough, so the designer added one brick. When Jiayuguan was finished, there was one brick left over, which was placed loose on one of the gates where it remains today.
  2. During the Ming dynasty, a talented architect named Yi Kaizhan was tasked to build this important outpost and finishing point for the Ming dynasty’s monumental construction effort. After finishing his plans, Yi announced that it would take exactly 99, 999 bricks to build the Jiayuguan structure, no more and no less. Yi’s supervisor thought that Yi was too arrogant and worried that any miscalculation on Yi’s part could reach the ears of the emporer with serious consequences, so he threatened that if Yi’s calculations were off, Yi and all of the workers would be punished. When construction was completed, there was one brick left over and the supervisor delightedly prepared to punish Yi for his arrogance. However, quick-witted Yi immediately told him that this extra brick had been placed by some supernatural being during the night to guard Jiayuguan and prevent its collapse, and that even the tiniest movement would cause the collapse of the entire outpost. The surpervisor, unwilling to take the risk, let the brick stay and was unable to punish Yi , and so the brick remains to this day.

Chinese Turtle Farm

A post in Teresa Burritt’s Frog Blog coincides nicely with some photos sent me by an old High School buddy of mine, who now lives in China. Shown here are two pictures from a set he took during a recent visit to a friend’s home. This particular farmer also raises frogs, lizards, and the insects which feed them, as well as producing home-made rice alcohol.
